My husband is going for custody of his son. He will be 10 the day after the hearing. He originally started the process of trying to get custody of his son because his mom was wanting to move to another state. She did NOT file the intent to relocate with the courts or notify him with a certified letter as is required by the state of Indiana. In Indiana the person with intent to move is required to prove it's in the best intrests of the child to move to the other state. Her reason for moving is because she is moving in with another man. She had a new job, but the way it sounds it was a part time job which wouldn't be "bettering herself". She just met this man in March and was divorced in February (not from my husband, a different man) So far, we've found her public intox, her OWI, her ex husbands OWI, her new boyfriends OWI, criminal conversion, check deception. Also, her new boyfriend has been sued by everyone and their brother.... this would prove the new man has little money and also, not "bettering" their lives. My husband and I have NO criminal records what so ever. She also had the police called on her because she was leaving the child home alone. The child is NOT responsible enough to be home alone, he can't make himself pbj sandwich. Only eats snacks all day, this was admitted to us by the child. Sex offenders live all around the area.... looked this up on the Indiana Sex Offender Registry. When police arrived mom happened to be home and lied to officer, officer told her if he got called out again, their would be more consequences. Right now mom lives in duplex apartment with no ac, so child is NOT allowed outside of home when she's not home, but there's no ac!! Child has been at his grandmothers house for at minimum of 6 weeks this summer and dads house 3 weeks. Mom was told that she was to offer child to dad if she couldn't care for him. She didn't. Mom hasn't seen child MOST of the summer because she has no daycare..... left him home alone when he was with her. She also told dad that because the police were called on her and she had no sitter, she had to take child to grandma... didn't offer to dad, that dad had to drive the 2.5 hours to pick the kid up from grandma... or not get him. She wouldn't meet him. This states that she won't drive to meet him if allowed to move to another state. Dad has always provided child with new shoes for school, new clothes throughout the year. Takes child on great family vacations. Includes child in everything family does. Mom does NOTHING!! (But drink) Dad lives in a 4 bedroom 2.5 bath home with living room, family room, game room in GREAT school district. Kids in dads custody only missed 3 days of school last year, child in question in mom's custody missed 12 (just the second semester!!) If mom asked dad to do something, dad ALWAYS did it. Child is ALWAYS first in dads eyes. What do you think? BTW... I have a huge paper trail to verify EVERYTHING!!
